Public and Employers Liability
In an increasingly litigious enviroment, it is imperative that you protect yourself against the following legal liabilities:
Public Liability
Covers your legal liability to pay damages to members of the public for death, bodily injury or damage to their property caused by you or your business activities. . It also covers legal fees, costs and expenses such as representation at any coroner’s inquest, fatal accident enquiry or other court hearing because of an accident. You will need to consider which limit of indemnity to choose very carefully - personal injury claims can often exceed £1 million.
Products Liability
Covers your legal liability for bodily injury to persons, or loss of or damage to property caused by defects in goods (including containers) sold, supplied, erected, installed, repaired, treated, manufactured, and/or tested by you.
Employer's Liability
Under the Employers Liability (Compulsory Insurance) Act 1969 all employers must insure against their legal liability for injury, disease or death to employees sustained by them and arising from their employment. Cover will enable you to meet the cost of any such compensation claims made against you.
An employee of the company is deemed to include those under contract of employment, plus apprentices and trainees. It will also include those hired from another employer. You are legally required to insure for at least £5 million but in practice, most policies offer £10 million minimum cover. The law also requires that you exhibit a certificate of employers’ liability insurance at each place of work.
Cover is normally purchased as part of a ‘combined’ or ‘package’ policy which includes a range of material damage, business interruption and liability covers. It can occasionally be bought separately as a ‘liabilities’ policy along with public liability cover.
